TERMS OF SERVICE

1. Eligibility and Age Restriction

The Service is strictly limited to users who are at least 18 years of age (or the age of majority in their jurisdiction, whichever is greater). By accessing FeetMash, you represent and warrant that you have the legal capacity to enter into a binding agreement and that you are 18 years of age or older.

• We do not knowingly collect information from or market to children under the age of 18.
• If we discover that you are under 18, your account will be terminated immediately.

2. User Accounts and Security

To access certain features (such as voting limits removal or content uploading), you must register for an account.

• Account Roles: You may register as a "Voter" or a "Creator". These roles are distinct and cannot be switched once created.
• Credentials: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
• Guest Users: Guests may access limited features (e.g., restricted voting). We use browser fingerprinting technologies to enforce voting limits for guest users.

3. Content and Conduct

3.1. User-Generated Content (UGC)

"Content" includes photos, images, text, and links uploaded by Creators.

• Ownership: Creators retain ownership of the Content they upload.
• License to FeetMash: By uploading Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to host, display, reproduce, distribute, and use your Content for the purpose of operating the Service (including the voting system and leaderboards).
• Warranties: You represent that you own the Content or have all necessary rights to grant us this license.

3.2. Prohibited Content

You agree NOT to upload or post:

• Illegal Content: Any content depicting minors (under 18), non-consensual sexual content, or violence. We have a zero-tolerance policy for child sexual abuse material (CSAM) and will report such content to law enforcement.
• Stolen Content: Material that infringes on the copyright or intellectual property of others.
• AI-Generated Content: Synthetic media or deepfakes.
• Spam/Misleading: False profiles or misleading links.

3.3. Prohibited Conduct

You agree not to:

• Manipulate the voting system using bots, scripts, or automated tools.
• Harass, bully, or intimidate other users.
• Impersonate any person or entity.

4. Creators and Verification

• Verification: To upload content, Creators must undergo a verification process. We reserve the right to reject any verification request at our sole discretion.
• External Links: Creators may include links to third-party platforms (e.g., OnlyFans, Fansly). FeetMash is not affiliated with these platforms and is not responsible for their content or terms.
• No Payments: FeetMash does not process payments. All monetization occurs on third-party external sites. We are not a party to any transaction between users.

5. Voting System and Rankings

• ELO Rating: We use an ELO-based algorithm to rank content. Rating updates are automated based on user votes.
• Fair Play: We reserve the right to nullify votes or modify rankings if we detect manipulation, "review bombing," or bot activity.

6. Moderation, Termination, and Shadowbanning

We reserve the right, at our sole discretion, to:

• Remove Content: Delete or disable access to any Content for any reason, without prior notice.
• Shadowban: Limit the visibility of your profile or Content without notifying you. This measure is used to combat spam and enforce our community guidelines.
• Terminate Accounts: Suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

7. DMCA and Copyright Policy

We respect the intellectual property rights of others. If you believe your copyright has been infringed, please follow our DMCA Policy or contact our Designated Agent at dmca@feetmash.com.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services (e.g., Supabase, Vercel, social media platforms) that are not owned or controlled by FeetMash. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

9. Disclaimers and Limitation of Liability

• "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• No Liability: In no event shall FeetMash, its operators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
• Adult Content: You acknowledge that the Service contains sexually explicit material. You access this content at your own risk.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
